Minutes of the Special Council Meeting of the Governing Body for the Village of Cloudcroft, held on Wednesday, July 1, 2020 at 10:00 a.m., in the Village Council Chambers, 201 Burro Avenue, Cloudcroft, NM.
Mayor David C. Venable called the meeting to order at 10:00 a.m. with the following Council members providing a full Quorum: Present/absent:
Trustee/ Mayor Pro Tern William Denney – present Trustee – James Maynard – present
Trustee – George Mitchell – present Trustee – John Tieman – present
The following Village staff and guests were present: Jini Turri, Admi nistrato;r Barbara K. Garcia, Village Clerk/Treasurer; Jefferson Rhodes, Village Attorney (Item #1)
The pledge of allegiance to the US and NM flags was led by Mayor David C. Venable. (Item #2)
APPROVAL OF AGENDA:
Mayor Venable entertained a motion to approve the Agenda for the Special Meeting of July 1, 2020. Trustee Denney made such motion, Trustee Mitchell seconded the motion and upon vote of Trustees Denney, Mitchell, Maynard and Tieman all voting “aye” the motion carried unanimousl.y(Item #3)
APPROVAL OF MINUTES:
Mayor Venable entertained a motion to approve the Minutes of the Special Council Meeting of June 25, 2020. Trustee Tieman made such motion to approve as written, Trustee Mitchell seconded the motion and upon vote of Trustees Denney, Mitchell, Maynard and Tieman all voting “aye” the motion carried unanimousl.y (Item #4)
Mayor Venable called for a motion to recess the open meeting pending arrival of Attorney Rhodes. Trustee Mitchell made such motion, Trustee Maynard seconded the motion and upon vote of Trustees Denney, Mitchell, Maynard and Tieman all voting “aye” the open meeting recessed until 10:50 a.m.
Mayor Venable reconvened into open session at 10:54 a.m.
EXECUTIVE SESSION: Recess into closed session In comp liancewith Threatened/Pending Litigation §10-15-1.H (7) David Black

Trustee Mitchell motioned to adjourn to Executive Session to discuss confidential materials concerning threatened pending litigation Black vs. Village of Cloudcroft. Mayor Venable acknowledged the motion and called for a second, Trustee Denney seconded the motion and with no further discussion a roll call vote was taken.

Council recessed into closed session at 10:55 a.m.
RECONVENE INTO OPEN SESSION:
Mayor Venable entertained a motion to adjourn from Executive Session and reconvene into Open Session at 11:34 a.m. Trustee Maynard made such motion; Trustee Mitchell seconded the motion and with no further discussion a roll call vote was taken.

Statement by Mayor Venable requested that the record reflect that the Governing Body of the Village of Cloudcroft, New Mexico, hereby states that on July 1, 2020 a Closed Executive Session was held and the matters discussed in the closed meeting were limited only to matters ofThreatened/Pending Litigation §10-15-1.H (7) David Black vs. Village of Cloudcroft as posted on the meeting notice. Mayor Venable noted that no action or votes were taken.
Trustee Maynard made a motion to authorize Mayor David C. Venable to engage in mediation with the plaintiff David Black. Trustee Mitchell seconded the motion and with no further discussion a roll call vote was taken.

Mayor Venable entertained a motion to hold a Regular Council Special Meeting on July 4, 2020 at 12:00 p.m. Trustee Maynard made such motion, Trustee Mitchell seconded the motion with voting as follows:
Trustee Denney – Nay Trustee Maynard – Aye Trustee Mitchell – Aye Trustee Tieman -Aye
Mayor Venable announced the vote to be three (3) to one (1) in favor the vote carries, and the meeting will be set for Saturday, July 4th, 2020. (Item #5)
ADJOURNMENT: Mayor Venable adjourned the meeting of July 1, 2020, at 11:40 a.m. (Item #6)
